Types of training

How to teach: with or without a license

When an employer hires a master, they consider:
- the number of courses completed, without an emphasis on the nature of the training – education or service;
- the quality of the master"s work.
State diplomas or certificates, in other words, are optional for the master and the prospective employer, provided that the latter already has a basic education. Schools choose not to obtain licenses and to teach without them because obtaining permission for educational activities is a time-consuming and costly process.
How to get a license
Getting a license to teach is a time-consuming and labor-intensive process. If you have made the decision to do so, read Federal Law No. 273-FZ, "On Education," first.
The terms of the activity’s license are outlined in Law No. 273-FZ, Article 91:
- premises. This can be property or rent, the main thing is that there is a document confirming the right to use;
- educational programs. Programs are developed by the organization independently and submitted along with the rest of the package of documents;
- teachers with specialized education. They must have the skills that are spelled out in the GOST for this type of service. For nail services – GOST R 58091-2018, for hairdressers – GOST R 51142-98;
- availability of a SEZ, sanitary and epidemiological conclusion. You need to get a SEZ from Rospotrebnadzor. To obtain it, you need to prepare an application for the issuance of a SEZ, the results of sanitary and epidemiological examinations and studies.
- a conclusion from the Ministry of Emergency Situations on the compliance of a building and premises with fire safety.
Provided to the Ministry of Education’s territorial department are the necessary paperwork, a license application, and a receipt for the state fee. A 30-to 40-day review period is in place for applications.
How to teach without a license
To instruct without obtaining a license:
- Register as an individual entrepreneur. In the application, indicate the OKVED code 85.41. As additional ones, you can indicate 96.02 and 47.75.
- Select the form of taxation;
- Find and equip the premises in accordance with SanPiN for organizations providing household services.
Steer clear of any criteria that could lead to the classification of your work as educational:
- do not use the combinations “received a profession”, “qualification awarded”. Courses are not educational activities and cannot assign a profession to a student;
- Do not conduct certifications and exams – this is one of the main signs of education;
- do not promise to issue state-issued certificates;
- do not position your activities as educational. This applies to advertising, contracts and the very presentation of information within the course.
Make it clear to students at the end of a contract that you are offering a consulting service when discussing work procedures and techniques. A student may file a statement under Article 14.17, "Deception of the Consumer," with Rospotrebnadzor if she believes the procedure is incorrect.
Issuance of certificates and diplomas
A certificate that is given out at a course by an organization without a license to teach is not a document; it is merely verification of the speaker’s veracity and has no legal standing.
Only accredited educational institutions are permitted to award diplomas, certificates, and state certifications. This certificate attests to the student’s completion of the course and his acquisition of the necessary knowledge, as demonstrated by his performance on an exam or certification project.
Certificate of internal sample
Similar to a certificate, an internal sample certificate is one that was independently established by the organization. It can be issued by any organization; supervisory organizations’ consent is not necessary.
According to the certificate:
- that the student "completed the course", "completed the master class", "attended the seminar" on a given topic;
- Student"s full name;
- date of completion;
- organization name.
One individual entrepreneur, who is either the studio and salon owner or a representative designated by him, signs the certificate. If the business owner is unable to sign certificates in person all the time, they can create a facsimile, which is a seal that mimics a signature. Organizations that hold seals can order facsimiles.
State-issued documents
An education license is required to issue educational documents that are issued by the state. A teacher can offer instructional services and subsequently receive a diploma in one of two ways:
- Obtain a license for your activities;
- Become a representative of an organization that has a license in your city. That is, you agree with the organization that you will be a representative of their school in your city. They make changes to the license, adding your address there, and you calmly teach. In this case, the student will sign the contract with the Moscow organization, and you will be the director of the branch.

The diploma shows:
- the name of the educational institution;
- a unique number of the diploma, certificate or certificate;
- full name of the student;

Contract with a teacher

Two categories of contracts exist:
- labor. Classic labor contract, as with a full-time employee. You will have to deduct taxes, insurance premiums from the teacher, and also pay him a salary, even when the training studio is recruiting groups or is idle without students;
- civil law. A contract for work implies a short-term provision of services, in our case – conducting courses. A civil law contract with an individual also obliges the employer to make tax deductions. If the teacher is registered as an individual entrepreneur, then he makes the deductions himself.
Signing a civil law contract is more advantageous financially because only the services that are rendered are compensated for.
Teachers are only officially hired under an employment contract if they have a license.
Contract with students
With students, a service provision contract is finalized.
In the agreement, note:
- passport data of the student, as well as the organization"s data – TIN, OGRNIP;
- name of the courses and their duration;
- amount of services rendered;
- circumstances under which the payment is returned in full or in part;
- terms for filing claims, for example, 1 day from the date of completion of the courses.
Make sure to sign the certificate of completion of work upon receiving it at the end of the courses to safeguard yourself against potential complaints from customers. Its form needs to be in the contract’s appendix.
The act attests to the fact that the customer has no grievances regarding the caliber of the service. Claims made after signing the act are not recognized.
